The COSHH Regulations have been in force since 1989, yet a large number of businesses - primarily but not exclusively, small to medium sized enterprises - have not achieved compliance. Others, while having done so, have failed to maintain the required standards. In either case such companies - and possibly their owners or directors - could face prosecution, particularly should an employee suffer injury as a result of exposure to a hazardous substance.
